It would definitely be different, but there's a good reason for it -- those who act willfully deserve more serious punishment. If, in fact, someone truly "mindlessly" drove over a number of people -- as in they were literally out of their mind and not aware of what they were doing or the consequences -- then I don't think they deserve the same sort of disdain that we reserve for those that act with full intent and knowledge of their actions.

I'm not suggesting that someone who acts mindlessly ought to get off scot free -- I've never been a big fan of the insanity defense -- but I would definitely react differently. My reaction would probably be along the lines of, "That's a real tragedy," rather than, "What punishment can I think up that will really make the rest of this guy's short-ass life miserable?"
