the bad part about is that it was worked out and discussed secretly and with participation of the music and movie industries. not the typical scenario you'd like your laws to originate from...
Well technically it is illegal if you don't have permission from every artist on your mix to republish their work, so SoundCloud has to remove the music if they get a complaint. Sucks but that is the way it is.

It's always been like that, sets are not deleted, that's another story, that's a real copyright infringement and you receive a warning.
If the scanning process finds a "protected" track they won't create the waveform but you still have the possibility to to appeal or simply change the track. No warnings.
I'm not saying it's not annoying but it's the labels's fault. And people who's going to play 128 files just to pretend they have all the promos.
I haven't seen anywhere yet on if this related to the servers in VA. It's been said the raid on his house in NZ was invalid, but what about where all of data lies, are the servers seized in VA still valid?
